Ohio Peace Officer Drafts NDAA Letter For Police And Sheriffs

Below is a letter composed by one of our peace officers in Ohio. This letter was written to raise awareness of the ominous problems in the National Defense Authorization Act of 2012.  Because Jim Singleton is a State chapter officer for Ohio Oath Keepers and is Ohio’s Peace Officer Liaison, this letter will be circulated within LE communities around Ohio. I am placing this letter on our national website as a guide and/or template for all Peace Officer members in Oath Keepers in all State chapters.  All are encouraged to write their own letters and mail to all Peace Officer offices in respective States. Oath Keepers is mobilizing on various fronts in response to the travesty called NDAA-2012. Oath Keepers salutes current-serving Peace Officer Jim Singleton, our Ohio chapter Secretary.

Greetings and Salutations,

It’s unfortunate that I have to write this letter, however in light of current events it is inevitable. Just days ago the United States Congress passed the NDAA (National Defense Authorization Act) this in itself was necessary. However in this bill was an insidious piece of verbiage that for all intents and purposes destroys the foundation of everything we believe in and took an oath to uphold. To me the possibility of those citizens and others under my protection being spirited off in the middle of the night by agents of the military, then being summarily incarcerated without access to judge or jury are insufferable and intolerable acts.

It will be argued that this only applies to foreign persons or others suspected of terrorism, but there are far too many avenues available to apply this to any group to which any administration may take umbrage with. When growing up and especially during our training in the academy we are instructed that the constitutional rights of all must be upheld at all times, as well as the respect for all people we come in contact with or represent. This section of the NDAA attempts to remove those rights which are enumerated and given to us by our creator, and places them in the hands of the office of the President of the United States to be disregarded at his whim.

And in those few words lies a conundrum, do we as police officers, sheriffs, deputies and others who have taken the oath to uphold and defend the constitution, now turn our back on that very oath? Do we now turn against the very same people that entrusted us with a most sacred duty to serve and protect them? If in fact we follow a rule of law such as this bill enacts, it would mean that the oath that we all took meant nothing. We are obliged to follow all lawful orders given to us, but we cannot do this blindly. History has seen the result of these acts and has judged them accordingly. I can only ask all of you to take a moment to reflect upon all that we are taught and hold dear, the people we serve deserve and demand our highest respect for it is through them and they alone that we were given this oath. Do we simply turn a blind eye for the sake of political expediency and lose our respect? Is a few pieces of silver so dear that we would sell our honor for it? How will we explain to our friends and loved ones why members of our community were spirited away or how will they see us when they realize (that when their time comes) we won’t be there for them?
I believe that if and when those orders come, I cannot in good faith and in strict observance to my oath, allow myself to be a part of them. I would hope that members of our military in accordance to the articles of the UCMJ, would also refuse them as well. When that time comes I will do exactly as I have sworn to do, I will serve and protect those under my care, so help me God.

 I just spoke to Sheriff Mack and was advised that PayPal has frozen that portion of the funds donated through PayPal ($40,000+) for the Constitutional Sheriff’s Conference.   PayPal has refused to release the funds and have stated that they may refund the donations to the donors.   They have cited no violation of law or online regulation.  They inquired if CSPOA.org was a 501C(3) and excused their actions on fear that the IRS would fine them.  Apparently someone opposing sheriffs learning they are not alone in their desire to live up to their oaths of office is involved.

ANTHEM – Maricopa County Sheriff’s Deputy William Coleman, 50, was shot and killed shortly after 4 a.m. on Sunday when he and two other deputies responded to a possible burglary in progress call in the Anthem community.

When deputies arrived behind the CVS shopping center at the northwest corner of Anthem Way and Galvin Parkway, Coleman tapped on the window of a minivan parked outside the Anthem Medical Plaza, where Drew Ryan Maras, 30, emerged from under a blanket and began shooting at him with a semiautomatic rifle.

The other deputies returned fire, killing Maras.

Arpaio said although Coleman was wearing a vest, that kind of body armor is no match for semiautomatic weapons.

While Maras fired 29 shots, Coleman’s vest was pierced twice by .223 caliber bullets.

Coleman, a 20-year veteran and the first MCSO deputy to be killed in the line of duty since 1995, leaves behind a wife and four children, including a 4 and 7-year-old.

The incident was still under investigation several hours later with the entire shopping center cordoned off with crime scene tape and it was unknown if anything was stolen by Maras.

Deputies also rescued a pit bull that was inside Maras’ van.

On Sunday Arpaio said, “Unfortunately, one of our deputies was killed in the line of duty today. It is extremely sad for everyone. He was an excellent officer.”

Due to the type of weapon used, there was speculation the incident was related to the shooting deaths of two New Hampshire visitors, whose bodies were discovered two days earlier in a red Subaru with the engine still running at an overlook in Sedona.

On Tuesday, MCSO confirmed the victims in the Sedona incident, identified as James Johnson and Carol Raynsford, both 63, were shot with the same semiautomatic .223 rifle.

Yavapai County Sheriff Scott Mascher said, “I don’t think we will ever know the motive” for the murdered couple, as robbery did not appear to be a motive.

Details about Maras have also been emerging, since MCSO released his identity on Tuesday.

And Maras is sounding eerily similar to Jared Loughner, the disturbed 23-year-old gunman charged with shooting and killing six people, including U.S. District Court Judge John Roll and injuring 14 others, including Rep. Gabrielle Giffords, at a public event in Tucson one year ago to the day, of Coleman’s murder.

It appears Maras had just moved out of his Peoria apartment days earlier and may have been living in his van.

He worked as a temporary employee with the Peoria Parks and Recreation Department until November 2011.

Maras was described by his neighbors at the Peoria apartment complex as a loner and someone who kept to himself, but became more talkative when discussing his book, “Open Your Eyes to 2012 and Beyond,” which provides “evidence” of an apocalyptic event that many believe will occur on Dec. 21, 2012, the end of the Mayan Calendar, along with his research of UFO incidents.

Maras served approximately four years of a six-year commitment in the U.S. Marine Corps in the 4th Marine Division in Chicago, leaving in 2003, although it remains unknown why he left early.

He enrolled in studies at Arizona State University during the spring and summer of 2004.

However, it appears Mara had a run-in with the law in 2000 while living and attending school in Gunnison, Colo., where he was arrested for under-age possession of alcohol and burglary for stealing a keg of beer from an office at Western State College where he was enrolled for one semester.

The charge was later reduced from second degree burglary to criminal mischief.

Records indicate Maras was sentenced to probation, 15 days in jail, a fine and was ordered to have a mental health evaluation.

While he was supposed to serve his jail term in Lake County, Ill., where he is originally from, there is no record of Maras ever serving any time in the Lake County Jail, although the Lake County Sheriff’s Office has a record of an incident in 2010, when his grandmother called 911 after Maras took some of her prescription medication in a possible suicide attempt.

According to MCSO, a flagpole has since been erected in Anthem at the scene of Colman’s murder, where people have created a shrine by leaving flowers and other mementos.

Public visitation to pay respects to Coleman will be held from 6 to 8 p.m. on Thursday, Jan. 12 at the North Phoenix Baptist Church, 5757 N. Central Ave., Phoenix.

Services will be held at the same location at 10 a.m. on Friday, Jan. 13.

Immediately following, the funeral procession will head to Phoenix Memorial Park, 200 W. Beardsley Road, Phoenix, where gravesite services will be held, complete with bugle, bagpipes and flyovers.

The cemetery is located along the westbound frontage road off the 101 Loop at 2nd Ave.

While the route of the procession is unknown, people can expect many road closures and heavy traffic in the area.

According to MCSO Lt. Rich Burden, an account has also been set up with Desert Schools Credit Union to assist Coleman’s family. Anyone wishing to make donations should make them to the Deputy Coleman Memorial Account: 6000123586.

Sheriffs from all over America are being invited to gather on Jan. 30, 2012 in Las Vegas, Nevada, for what could be the most important meeting “since the Constitutional Convention of 1787,” according to Constitutional Sheriffs and Peace Officers Association (CSPOA) founder Richard Mack.

AFP recently spoke with Mack by cell phone as he zigzagged by car across Florida as a guest speaker for various groups.

As Americans push back with their tea party and occupy movements, screaming at the corruption of big banks and Wall Street, they still have not realized the rudimentary solution right in their own backyards, says CSPOA.

Mack is the former sheriff of Graham County, Ariz. who took the federal government under President Bill Clinton to the Supreme Court in the 1990s in a “David vs. Goliath” struggle that he won. His efforts stopped the Brady Bill from forcing all county sheriffs to do federal paperwork and conduct background checks on gun buyers. Now he is taking another giant step to educate some 2,000 county sheriffs across the nation who have been so numbed with bureaucratic propaganda many don’t even remember the meaning of their oaths of office or the rulebook they swore to follow.

“Your local sheriff needs to know,” Mack told AFP, “that there is nothing that the UN or the New World Order boys or the feds want to shove down our otherwise healthy throats that we cannot stop at the county level with a constitutionally educated sheriff.”

The goal, according to Mack, is to get 10 percent of all the sheriffs, or about 200, from around the nation on board for a free education. He figures that when 200 of them begin to behave constitutionally by telling federal agents not to step beyond their county boundaries and taking positive action to prevent it, much of the remaining majority will wake up.

Here is CSPOA’s plan: raise $200,000 to bring 200 county sheriffs to the Nevada conference at an average cost of $1,000 each. This may not be as high a mountain to scale as it sounds because many citizens are so anxious for their sheriffs to attend, they already have taken it upon themselves to send them. This has greatly lightened CSPOA’s load.

We are told that security will be tight and no employees from any federal agency will be allowed inside the meeting room. Anyone not endorsed and accompanied by a visiting sheriff will be turned away. However, any private citizen who wishes to pay $1,000 may sit in, as the money will be used to fund the expenses of another out-of-state sheriff.

“We have collected nearly $50,000 and need only $100,000 more because of the commitment of various county citizens who strongly want their sheriff to be there and are willing to raise the money locally,” said Mack. “This is what we need a few more counties to do.”

Raising only $1,000 for the good of one’s county is far easier than Mack’s effort of trying to raise $200,000 on his own, but he hasn’t slowed down.

There are 17 active sheriffs from 14 different states who sit on the board of directors of CSPOA, and many of them have admitted that they did not live up to their oaths of office until recently because they simply didn’t know any better. Many are angry and repentant.

Some who would be there cannot—such as former sheriff Melvin Holly of Latimer County, Okla. He is incarcerated in federal prison. Holly’s crime: He attempted to stop a drug-running operation in his county that was apparently federally sanctioned. His error? He didn’t stop investigating and ended up framed for multiple sex crimes he says never happened. Holly was then convicted after witnesses reportedly received payoffs for their deceitful testimony.

It is a growing problem that all sheriffs face because of the Fed’s ability to create unconstitutional money and the feds’ ability to pass  unconstitutional statutes legalizing payoffs to witnesses in the event of a conviction. But almost no lawyers, let alone sheriffs, even knew that these statutes existed before AFP’s story alerted them last year. See AFP’s Aug. 16, 2010 edition (#33) for that article.

“The bottom line is that county sheriffs need to know that their power exceeds that of federal interlopers,” pointed out Mack. “Ultimately, he is the one who will decide what is and what is not enforced in the county. He has the authority and an oath-bound duty to interpose himself on the citizen’s behalf to protect you from all enemies, both foreign and domestic. But a large majority of these 2,000 sheriffs just don’t know it.”

Georgians got a dose of this power on Dec. 1 when Fulton County (Atlanta) sheriff’s deputies defied a court by refusing to evict bedridden Vita Lee, 104, and her 83- year-old daughter from their home of 53 years.

“We are not in trouble in this country because we follow the Constitution too closely,” Mack told AFP. “Just the opposite. But there is a way to get back to it, sheriff by sheriff, county by county.”
