Texas Department of Public Safety officials are asking questions following a report that Department of Homeland Security Advisory Council member Mohamed Elibiary may have been given access to a sensitive database of state and local intelligence reports, and then allegedly shopped some of those materials to a media outlet. He allegedly used the documents to claim the department was promoting “Islamophobia” — claims that the media outlet ultimately rejected. They declined to do the story.

Earlier today, I received confirmation from a left-leaning media outlet that Elibiary had recently approached them asking to do a story attacking Texas DPS:

Yes, he approached us and gave us some reports marked FOUO [For Official Use Only] that he said showed a pattern of Islamophobia at the department. He emphasized that some of the regional fusion centers were shut down a few years ago after the ACLU complained that they were targeting Muslim civil rights groups and said that this was being directed by [Texas Gov.] Rick Perry.

We looked at the reports and they weren’t as he had billed them to us. They seem to be pretty straightforward, nothing remotely resembling Islamophobia that we saw. I think he was hoping we would bite and not give it too much of a look in light of the other media outfits jumping on the Islamophobia bandwagon.

I asked if there was any sense of his possible motivation:

Oh, self-promotion definitely. It was clear up front that he wanted to be a quoted source in the story. We’ve used him as an unnamed source in previous stories. There’s nothing unusual or unseemly about that because officials do it all the time, but this was the first time he approached us with documents. Honestly, if they had been what he represented them as we would have probably run with the story. But we looked at them and saw this was a partisan hatchet job that could blow back on us so we passed on it.

In light of these allegations, I spoke today with Texas DPS Director Steve McCraw. He confirmed that Elibiary has access to the Homeland Security State and Local Intelligence Community of Interest (HS SLIC) database, which contains hundreds of thousands of intelligence reports and products that are intended for intelligence sharing between law enforcement agencies.

(Full disclosure: I gave a briefing in April 2010 to the TX DPS on historical terror incidents and terror connections to Texas. I’ve also been critical of Elibiary’s involvement with DHS considering his past extremist statements and activities.)

I asked Director McCraw if he knew whether Elibiary had access to TX DPS reports on the HS SLIC, to which he replied:

We know that he has accessed DPS documents and downloaded them.

McCraw stated that he will be requesting that DHS conduct an investigation to determine whether or not Elibiary improperly handled any sensitive intelligence products, and said that he will reserve judgment until an investigation is complete. He added:

If in fact this happened we will be extremely disappointed in him. We’ve worked with him and other groups to get their comments regarding a wide range of issue in order to be inclusive.

In fact, Elibiary received his first official position serving on the TX DPS Advisory Board and leveraged that position into his current positions with DHS and the National Counterterrorism Center. Elibiary was appointed to the Homeland Security Advisory Council in October 2010.

I asked Director McCraw about the nature of their work product:

We do have a process in place that ensures the quality of our product going all the way to our assistant director of intelligence and counterterrorism. Our training of employees has been extensive and adheres to all Department of Justice and Homeland Security privacy and civil liberties policies. The ACLU was involved in our process for establishing the fusion center statute passed by the state legislature.

I asked about the potential impact of a security breach that has been alleged to have occurred in this instance:

This system allows intelligence agencies to share products. These products are meant to be for official use only and anyone working for the Department of Homeland Security attempting to use it in any other way undermines the efficacy of the program. If DHS has cleared somebody for access we have no questions, but if they violate the confidentiality of the system it has a chilling impact on sharing information, and that’s the last thing we need.

Following these interviews, I contacted both Mohamed Elibiary and the Department of Homeland Security asking for comment. At present I have not received a response from Elibiary, but I did speak with DHS spokesman Chris Ortman, who immediately demanded to know who my source was.

When I explained that I had become aware of Elibiary’s alleged approach to the media organization from a third party and directly contacted that publication for comment (which they gave under the condition of anonymity) and began reading the quotes I had been given, Ortman immediately interrupted and expressed skepticism:

In all my eight years working in media I have never heard of such a situation where a third party contacts a reporter at one outlet and tells them that another news outlet has spiked a story.

Mr. Ortman is significantly out of touch regarding this; it is likely a daily occurrence at a number of outlets.

When I directly asked Ortman about who gave Mohamed Elibiary access to the HS SLIC system, he abruptly ended the conversation and said he would need to call me back. After more than an hour wait and knowing from other sources that senior aides for DHS Secretary Napolitano had been fully briefed late last night on the matter and that the story is quickly leaking out, we are publishing what we have so far.

We’ll bring you any additional details, including any further comment from Elibiary or DHS on this story.

When Mohamed Elibiary was appointed earlier this year to the Department of Homeland Security’s newly-formed Countering Violent Extremism Working Group, it was done quietly and without fanfare. It’s hard to believe that this silence was accidental, considering Elibiary’s appearance at a conference honoring Ayatollah Khomeini, his attacks on prosecution of terrorist fundraisers, his active promotion of jihadist ideology godfather Sayyid Qutb, and the threat he made against a Dallas Morning News journalist who repeatedly exposed his extremist views.

But none of that has stopped Mohamed Elibiary from promoting himself as a “de-radicalization” expert courted not only by Janet Napolitano and the Department of Homeland Security, but testifying before Congress earlier this year, giving briefings to the Congressional Research Service, and being hailed by the establishment media.

Perhaps the hardest thing for Elibiary to explain away is his sharing the podium with a rabid anti-American and anti-Jewish speaker who has publicly pledged his loyalty to the Iranian regime, but he has offered several fantastic explanations for appearing at the December 2004 conference honoring the life and works of the “Great Islamic Visionary” Ayatollah Ruhollah Khomeini.

The Dallas Morning News condemned the meeting and its high-profile speakers as a “disgrace”, Elibiary defended his appearance by claiming that he never knew the conference was to honor Khomeini and that he endorsed the conference out of “Muslim unity” and his hopes to present a “moderating counterpoint” – one that apparently was never offered.

When the local CBS affiliate reported that keynote speaker and outspoken Khomeini enthusiast Mohammad Al-Asihad delivered an anti-American, anti-Jewish harangue during the conference, and a 10-year old boy had opened the conference praising Khomeini for reviving “pure Islamic thinking” and calling President Bush “the greatest enemy of the Muslim Ummah”, Elibiary conveniently claimed that he didn’t hear those comments since he had arrived after the boy spoke and before Al-Asi’s speech. He has elaborated on those excuses for speaking at the event on his own website.

More recently, Elibiary has publicly attacked the prosecution the Holy Land Foundation executives who were convicted of raising millions in support of Hamas, and a landmark Supreme Court decision earlier this year that backed federal laws prohibiting material support for terrorism.

When Elibiary testified before Congress earlier this year, his status as a “de-radicalization expert” was challenged by the Investigative Project on Terrorism, who noted his running online feud with Dallas Morning News editorial page editor Rod Dreher over Elibiary’s defense of the godfather of jihadist ideology, Sayyid Qutb. The 9/11 Commissionobserved that Qutb was instrumental in developing the ideological foundations of Al-Qaeda’s terrorist worldview that justified the 9/11 attacks and inspired Osama bin Laden.

When Elibiary was cited as an expert source by the Congressional Research Service in a study published last November, Dreher recounted some of the defenses made by Elibiary in defense of Qutb in response to an editorialidentifying the threat from Qutb’s jihadist ideology. This included Elibiary’s stated position that some who have read Qutb’s writings saw “the potential for a strong spiritual rebirth that’s truly ecumenical allowing all faiths practiced in America to enrich us and motivate us to serve God better by serving our fellow man more.” Dreher reprinted some of Qutb’s statements calling for the establishment of a global Islamic state, the imposition of shariah law, and carrying out violence against non-Muslims and non-compliant Muslims until the entire world is in submission to Allah and Islamic law.

Even more disturbing is an email exchange the two had in 2006, where Elibiary called Dreher “a Klansman without a hood” and warned “treat people as inferiors and you can expect someone to put a banana in your exhaust pipe or something.”

With that in mind, it is hard to understand why the Department of Homeland Security would be embracing Mohamed Elibiary and seeking his counsel. It would be one thing if they understood their outreach to Elibiary as an attempt to engage extremists, but it is clear that Janet Napolitano and her DHS colleagues believes that Elibiary is part of the solution, rather than part of the problem.

One only needs to read the lame recommendations offered by the Countering Violent Extremism Working Group to identify the corrosive effect of trying to mainstream extremists like Mohamed Elibiary is having on U.S. government policy concerning violent Islamic ideology.

It is good to see other influential voices on the political landscape calling out Rick Perry on the Islamic propaganda and whitewash curriculumhe instituted in Texas. Props to Tom Tancredo for calling Rick Perry out on his proselytizing program in the public schools.

Perry never answered for it. He never did a mea culpa on the brainwashing of tens of thousands of Texas children. He certainly did a 180 on the Gardasil-HPV vaccine. This is even more dangerous to our young.

What is not yet as widely known about Perry is that he extends his taxpayer-funded compassion not only to illegal aliens but also to Muslim groups seeking to whitewash the violent history of that religion. Perry endorsed and facilitated the adoption in Texas publicschools of a pro-Muslim curriculum unit developed by Muslim clerics in Pakistan.

Perry’s connections to Muslim groups in Texas are well documented. A recent Christian Science Monitor story said, “Perry has attended a number of Ismaili events in Texas, brokered a few agreements between the state and Ismailis (including the legislation introducing Islamic curricula into Texas schools), and even laid the first brick at the groundbreaking ceremony for an Ismaili worship center in Plano in 2005.”

The Muslim Histories and Cultures (MHC) project was formalized in 2004 in a signed agreement between the University of Texas at Austin and Aga Khan University in Pakistan. The announcement of the MHC project credited Gov. Perry by name with being “instrumental” in its launch.

The agreement calls for an extensive program of bi-cultural teacher training funded jointly by both parties. More than 200 Texas teachers have been trained in the program, which is ongoing. The project’s curriculum units were initially available for viewing on the university’s website, but have since been scrubbed from the Internet. It appears Texas officials do not want the curriculum examined by Texas taxpayers.

Islam scholar Robert Spencer, head of Jihad Watch, examined the program and concluded, “The curriculum is a complete whitewash and it’s got the endorsement of Perry. It’s not going to give you any idea why people are waging jihad against the West — it’s only going to make you think that the real problem is ‘Islamophobia.’”

Perhaps Spencer exaggerates the curriculum’s bias? Examine it for yourself here.

Perry’s close ties to Muslim groups led the political blog Salon to headline a recent story: “Rick Perry: The pro-Sharia candidate?” Evidence in support of that theme comes from Gov. Perry’s refusal to support legislation sponsored by Texas Republican legislators to outlaw Sharia law in Texas.
